This Privacy Notice explains our practices, defines our users’ (“you” or “your”) privacy options, and describes how your information is collected and used by Stability Biologics, LLC (“we,” “us,” “our,” or “Stability”).
This Privacy Notice governs your use of Stability website at https://www.stabilitybio.com/ and any related subdomains thereof (the “Site”), and any information we may access through our social media platforms such as LinkedIn or Twitter. For the purposes of this Privacy Notice, we will refer to all of these access points, together with the provision of regenerative medicine services to customers, as services (the “Services”).
Personal Information means any identifying information, usually your name in combination with another identifier, such as date of birth, postal address, email address, telephone number, or government-issued identification number. Personal Information does not include anonymous or aggregated data that can no longer be used to identify a specific person, even if combined with other data. The specific definition of Personal Information varies from one jurisdiction to another.
We may update this Privacy Notice from time to time and will mark new versions with a corresponding effective date. We recommend you visit the Site to review any changes in our practices. Your continued use of the Services constitutes your agreement to our then-current Privacy Notice.
What Information is Collected?
Information Collected Directly from You
Stability provides its products and services exclusively to licensed healthcare providers, medical centers and clinics, organizations, and other such business entities located in the United States. We do not market, sell, or otherwise direct our products or services to individuals acting in a personal or household capacity. We may collect Personal Information about you in this business-to-business context when you request an initial consultation or more information about our Services by calling or emailing us, or as part of other online services. The lawful basis for collection of this information is based on your consent, Stability’s legitimate interest, or as necessary to fulfill a contract with you.
The information we may collect includes, but may not be limited to:

Information Collected Automatically
To provide you with Services, complete your requests, and maintain functional Services, we may automatically collect certain information when you visit or navigate the Services, including:
• Location, date, and time you access the Services, and IP addresses to measure our Site traffic and to help provide a more personalized experience;
• Your browser type and other technical specifications such as device ID, hardware/software type, internet service provider, serving domains;
• Your search and transaction history relating to the use of our Services;
• Files that allow us to “recognize” you when you navigate the Site, and collect data such as analytics, page views, and interaction data; and

Information Collected From Third Parties
We may obtain Personal Information about you from third party sources, including data brokers, marketing partners, public databases or other publicly available sources.
Health Information
We are a business associate with respect to any Personal Information we collect and process of patients on behalf of covered entities that is considered Protected Health Information under the Health Insurance Portability and Accountability Act (“HIPAA”). Any Protected Health Information is subject to the terms of our Business Associate Agreement or Addendum in place with the covered entity.
Collecting Information from Children Under the Age of 16
Our Site and Services are not designed or targeted for children, and we do not knowingly collect, maintain, or use Personal Information from any person under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with Personal Information, please contact us so that we may delete such information. We encourage parents and legal guardians to monitor their children’s internet usage and to help enforce our Privacy Notice by instructing their children never to provide Personal Information on our Services without their permission. If you learn that a child under the age of 16 has provided us with Personal Information in violation of this Privacy Notice, then you may alert us at bmartin@stabilitybio.com. We will take reasonable steps to delete that information as quickly as possible.
How Is the Information We Collect Used?
We collect information about you in order to provide you with services and products, and to make the Services work properly. We use Personal Information for a variety of purposes related to our business, including but not limited to:
Providing services and support
Performing the essential functions of the Services including responding to inquiries, fulfilling business orders and requests, processing payments, providing support and troubleshooting, data aggregation, analysis and report creation to assess marketing effectiveness and/or business performance, and communicating with users about their use of the Services or responding to a user-initiated inquiry on the Services.
Communicating with users about products or services
Sending or initiating direct marketing programs, such as newsletters or information about new products or services we are offering; using content from social media platforms where users discuss our products or use a hashtag related to our products.
Personalizing user experiences on our Services
Tailoring content on the Services based on user location, preferences, and other personalization factors.
Analytics and Services improvement
Tracking information about your visits to our Site or use of the Services to allow us to provide better service, using certain online preferences in the aggregate across all users to evaluate the Services and develop additional products and services to offer.
Compliance with legal obligations
Sharing information as required or appropriate to comply with the law or a legal proceeding, such as in response to a subpoena or court order, to detect and investigate security incidents and potentially illegal or prohibited activities or to protect your, our, or others’ rights, property, or safety.

Service Providers
We may share non-individual information, in the aggregate, regarding your online browsing preferences to evaluate our products or allow the service providers with whom we work with to better serve our users. We will not share personally identifiable information in these instances, other than as described in this Privacy Notice.
We may provide user information to our service providers or vendors for reasons such as:

Legal and Compliance

We may also disclose your information to a third party as part of a reorganization or a sale of the assets of Stability, or its subsidiaries or divisions. Any third party to which Stability transfers or sells the Services or related assets will have the right to continue to use the personal and other information that you provide to us. In the event of an insolvency, bankruptcy, or receivership, your Personal Information may also be transferred as a business asset.
Cookies, Pixels, and Similar Technologies
We use cookies, pixels, and similar technologies to gather information about your use of our Services and to customize your experience using the Services.
Pixels
Pixels are small transparent images embedded in the Services, emails or ads and may provide information to platforms who may combine your information with other information they have about you. We use pixels to automatically collect information when you visit our Services. Analytics
We use third-party advertising and analytics providers, including platforms such as Google, to help create reports and statistics on the performance of the Site. These platforms may receive information about your interactions with the Services. Stability does not control these third parties’ data collection practices or how the information they collect is used. These platforms operate independently and process information in accordance with their own privacy policies. If you don’t want Google Analytics to be used in your browser, you can install the “Google Analytics Opt-Out Browser Add-On,” provided by Google.
Third Party Websites and Links
Our Services may contain links to other websites. These websites may have privacy policies different from our Privacy Notice. The Services may also contain certain social media icons or widgets. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media or other third-party websites is governed not by this Privacy Notice but by the terms of use and privacy policy of the particular platform.
Security and Data Retention
We make reasonable efforts to maintain administrative, physical, and technical safeguards for all Personal Information collected in our Services, designed to protect your Personal Information from unauthorized access and against unlawful processing, accidental loss, destruction and damage. Unfortunately, the transmission of information via the internet is not completely secure, and we cannot make any guarantees as to the security or privacy of your Personal Information.
We retain data collected from you only for as long as necessary to complete the purpose for which it was collected.
International Transfers
Our Services are primarily targeted to businesses in the United States, and the Personal Information that we collect is stored on servers hosted by us or our authorized third-party service providers located in the United States and elsewhere. This means that your Personal Information will be collected, processed, and stored in the United States or other countries, which may have data protection laws that are different from (and sometimes less protective than) the laws of your country or region.
By sending us Personal Information, you agree and consent to the processing of your Personal Information in the United States, which may not offer an equivalent level of protection to that required in other countries (particularly the European Union), and to the processing of that information by us on servers located in the United States, as described in this Privacy Notice.
We have implemented safeguards we believe are designed to ensure that the Personal Information we process remains protected in accordance with this Privacy Notice, including when processed internationally or by our third-party service providers. The safeguards we may take in our discretion include, for instance, entering into specific agreements in connection with any onward transfers of Personal Information. We may implement other mechanisms and take similar appropriate safeguards with our third-party service providers.

As applicable, California residents may have certain privacy rights relating to their Personal Information as described below:

We do not process sensitive Personal Information for purposes other than to provide the Services.
When we receive your request, we may first verify your identity by asking you to provide your name and the email address and phone number reflected in our records. Once we have verified your identity, we may fulfill your request, as applicable. You may authorize an agent to submit a request on your behalf. We will require (1) the agent to present written permission to do so, signed by you, (2) you to verify your own identity as described above, and (3) you to directly confirm to us that you provided the authorized agent permission to submit the request.
Selling And Sharing Personal Information
We do not sell your Personal Information to third parties for profit. Like most companies that operate online, we use online analytics to measure the ways users engage with our Services and to provide targeted marketing. These analytics, in turn, inform how we perform online advertising. In order to provide these analytics for cross-contextual behavioral advertising and facilitate online advertising, we use third parties that collect device identifiers and place tags, pixels, cookies, beacons, and similar tracking mechanisms on our Services as set forth in this Privacy Notice. As such, California law may classify this limited sharing with contracted third parties as a “sale” or “share” of Personal Information. Other than as set forth in this Privacy Notice, we do not collect or process Personal Information that may be considered “sensitive.” We do not use Personal Information for profiling in furtherance of decisions that produce legal or similarly significant effects for a consumer.
The exact scope of these rights may vary by state. To exercise any of these rights, or to appeal a decision regarding a consumer rights request, please contact us at bmartin@stabilitybio.com. Please note that we may need to authenticate your identity before your request can be processed, providing us with 2-3 pieces of Personal Information which we will match to the information we maintain about you. For authentication, you may be asked to provide certain Personal Information that we will match against our records. You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed.
We will not discriminate against you in a manner prohibited by applicable laws because you exercise your privacy rights. We welcome you to exercise any privacy rights applicable to you.
Do Not Track Signals
The Services do not respond to browsers’ Do Not Track signals. We honor the Global Privacy Control.
